Effective: June 2025  ·  MyRehab Vault — serving the Caribbean Community (CARICOM)

These Partner Terms & Conditions ("Agreement") govern your participation in the MyRehab Vault partner programme operated by MyRehab Vault, a company registered in Barbados ("Company", "we", "us").

MyRehab Vault is a digital health platform designed to serve patients and healthcare professionals across the Caribbean Community (CARICOM) member states and the wider Caribbean region. This Agreement is intended to be consistent with the legal frameworks applicable across CARICOM territories, including Barbados, Trinidad & Tobago, Jamaica, Guyana, Belize, and the Organisation of Eastern Caribbean States (OECS) member states.

By creating a partner account you confirm that you have read, understood, and agree to be bound by this Agreement in full. This Agreement constitutes a legally binding electronic contract under the Electronic Transactions Act, Cap. 308B (Barbados)and equivalent legislation in other CARICOM member states, including the Electronic Transactions Act of Trinidad & Tobago and similar OECS model legislation.

Eligibility

To become a MyRehab Vault partner you must:

  • Be a licensed or credentialed healthcare professional — including physiotherapists, occupational therapists, chiropractors, athletic trainers, or holders of an equivalent qualification recognised within your jurisdiction.
  • Hold current registration with the relevant regulatory authority in your territory (for example: the Allied Health Professions Council of Barbados; the Board of Registration of Medical Practitioners (Trinidad & Tobago); the Council for Professions Supplementary to Medicine (Jamaica); or the equivalent OECS state authority).
  • Where applicable, hold a valid CARICOM Skills Certificate issued under the Caribbean Single Market and Economy (CSME) free movement of skills framework, if practising across multiple CARICOM member states.
  • Be at least 18 years of age.
  • Have the legal right to upload, distribute, and monetise the content you submit.
  • Not be subject to any professional disciplinary order in any CARICOM or international jurisdiction that would prohibit you from practising in your field.

We reserve the right to request proof of credentials and registration at any time and to suspend or terminate accounts where eligibility cannot be verified.

Revenue Share

For every paid sale of your content processed through the platform, revenue is split as follows:

Platform fee

  • The 30% platform fee covers payment processing (Stripe), hosting, customer support, fraud protection, and platform maintenance.
  • Free content generates no revenue and is not subject to the revenue split.
  • Revenue calculations are based on the net amount received by the platform after any payment processor charges.
  • Revenue share percentages may be renegotiated by mutual written agreement but will never change unilaterally with less than 30 days' notice.

Payment Terms

  • Earnings are calculated monthly and paid within 30 days of the end of each calendar month in which they were earned.
  • All payments are denominated and settled in United States Dollars (USD), which is the standard reference currency for cross-border transactions in the Caribbean region.
  • Payment will be made via the method agreed at account setup (bank transfer, ACH, or other supported method).
  • A minimum payout threshold of USD $20.00 applies. Balances below this threshold roll over to the following month.
  • Tax obligations:You are solely responsible for declaring and paying any income tax, Value Added Tax (VAT), or equivalent consumption tax (such as Barbados VAT, Trinidad & Tobago VAT, Jamaica GCT, or applicable OECS VAT) arising from payments received. We will provide monthly transaction records on request to support your local tax filings. We do not withhold tax on your behalf.
  • National Insurance:Where applicable under the laws of your territory (e.g., Barbados NIS, Trinidad & Tobago NIS, Jamaica NIS), you are responsible for any National Insurance Scheme contributions payable on income earned through this platform.
  • Payments may be withheld pending resolution of any dispute, fraud investigation, or content violation.

Content Standards

All content you upload must:

  • Be accurate, evidence-based, and consistent with current professional standards in your field as recognised by your relevant Caribbean regulatory body.
  • Clearly indicate the target patient population and any contraindications.
  • Not make unsubstantiated medical claims or guarantee treatment outcomes.
  • Comply with the healthcare advertising standards and professional conduct codes applicable in your territory (including, where relevant, the Medical Professions Act (Barbados), the Allied Health Professions Act (Trinidad & Tobago), and equivalent legislation across OECS member states).
  • Not include content that is unlawful, defamatory, discriminatory, or sexually explicit under the laws of any CARICOM member state.
  • Not feature third-party copyrighted material (music, footage, branded products) without written permission — copyright is protected throughout CARICOM under the Berne Convention, to which all member states are signatories.
  • Feature only yourself or consenting individuals who have provided appropriate written releases.

We reserve the right to review, reject, or remove any content that does not meet these standards at our sole discretion.

Intellectual Property

You retain full ownership of all content you upload. Intellectual property rights in the Caribbean are protected under national copyright legislation including the Copyright Act (Barbados, Cap. 300), the Copyright Act (Jamaica), the Copyright Act (Trinidad & Tobago), and equivalent legislation in OECS states — all of which align with the Berne Convention and TRIPS Agreement.

By uploading content you grant MyRehab Vault a non-exclusive, royalty-free licence to host, stream, display, and promote your content on the platform for the duration of this Agreement.

This licence does not permit us to sell, sublicense, or redistribute your content outside of the platform without your prior written consent.

Upon termination of your account, this licence ends and your content will be removed from public access within 14 days, except where retention is required to fulfil existing paid access already granted to users.

Data Protection & Privacy

MyRehab Vault collects and processes personal data in accordance with applicable Caribbean data protection legislation, principally the Barbados Data Protection Act 2019. Partners in other CARICOM member states should note that additional national laws may apply to data about their patients and clients, including:

  • Trinidad & Tobago: Data Protection Act 2011 (Chap. 22:02)
  • Jamaica: Data Protection Act 2020
  • OECS member states: Territories implementing the OECS model data protection legislation, including the Eastern Caribbean Data Protection Act framework.

By using the platform you agree that:

  • Your personal and professional information will be stored and processed by MyRehab Vault solely for the purposes of operating the partner programme.
  • You will not upload any personally identifiable patient information to the platform. All content must be de-identified in accordance with the data protection laws of your territory.
  • You have obtained any necessary consents from individuals who appear in your videos under the relevant data protection and privacy laws of your territory.
  • You have the right to request access to, correction of, or deletion of your personal data held by us, consistent with the rights granted under the Barbados Data Protection Act 2019 and equivalent Caribbean legislation.

Professional Responsibility & Liability

You acknowledge that:

  • Your content is not a substitute for in-person clinical assessment or treatment. You must include an appropriate disclaimer in every video intended for patient self-care.
  • You remain bound by the professional conduct standards and codes of ethics of your relevant Caribbean regulatory body, regardless of the medium through which you deliver content.
  • You are solely responsible for the professional accuracy and safety of your content, including compliance with the healthcare standards of every CARICOM territory in which your content is accessed.
  • MyRehab Vault is a technology platform and does not provide medical advice, clinical oversight, or professional indemnity coverage.
  • You are strongly encouraged to ensure that your existing professional indemnity insurance covers online content delivery. Policies issued by regional providers such as Sagicor or international underwriters active in the Caribbean may need to be reviewed for this purpose.
  • You agree to indemnify and hold harmless MyRehab Vault, its directors, and employees from any claim, loss, or liability arising from your content or your breach of this Agreement.

Account & Termination

  • Either party may terminate this Agreement at any time with 14 days' written notice.
  • We may suspend or terminate your account immediately and without notice for breach of these terms, fraudulent activity, or professional misconduct.
  • Upon termination, outstanding earnings above the minimum payout threshold will be paid at the next scheduled payment date.
  • You must not create duplicate accounts or share account credentials with any other person.
  • Termination does not affect any rights or obligations that accrued before the termination date.

Changes to These Terms

We may update these terms from time to time to reflect changes in Caribbean law, CARICOM regulatory frameworks, or our platform operations. Material changes will be notified by email at least 30 days before they take effect. Your continued use of the platform after that date constitutes acceptance of the revised terms. If you do not agree to the revised terms you may terminate your account before the changes take effect without penalty.

Governing Law & Jurisdiction

This Agreement is governed by and construed in accordance with the laws of Barbados, consistent with the Company's registration and place of business.

Any dispute arising under or in connection with this Agreement that cannot be resolved by negotiation shall be referred to the courts of Barbados. As a CARICOM member state that has acceded to the Agreement Establishing the Caribbean Court of Justice, Barbados recognises the Caribbean Court of Justice (CCJ) as its final appellate court — replacing the Privy Council for civil matters since 2005.

Partners based in OECS member states (including Antigua & Barbuda, Dominica, Grenada, St Kitts & Nevis, Saint Lucia, and St Vincent & the Grenadines) acknowledge that the Eastern Caribbean Supreme Court has jurisdiction in their respective territories and that any local professional or consumer protection obligations under OECS law remain independently applicable to them.

Nothing in this Agreement limits any rights a partner may have under the consumer or professional protection laws of their own CARICOM territory.

Electronic Commerce

This Agreement is formed electronically and is legally binding under:

  • Electronic Transactions Act, Cap. 308B (Barbados) — governing electronic contracts, electronic signatures, and online records.
  • Equivalent electronic commerce legislation across CARICOM, including the Electronic Transactions Act (Trinidad & Tobago), the Electronic Transactions Act (Jamaica), and OECS state-level electronic commerce legislation based on the UNCITRAL Model Law on Electronic Commerce.

By ticking the acceptance checkbox and creating your account, you are providing a valid electronic signature and forming a binding contract in accordance with the above legislation.
